How to Deal With Your Second DUI Charge

The state of Michigan is very serious about its driving under the influence (DUI) laws. If you have already been apprehended on DUI charges, and you get pulled over again for the same offense, there are some actions you can take to lessen the punishment.

  • Avoid resisting arrest. If you refuse to take a urine, blood or breath test after your arrest for an alcohol-related charge, you need to take action to obtain an administrative hearing within 14 days or your license is at risk of suspension.
  • Find a qualified DUI law attorney as soon as possible.
  • Understand that according to Michigan law, the prosecutor has to prove that you are operating a motor vehicle while you are under the influence. This must be proven beyond a reasonable doubt.
  • Know your rights when asking for evidence. You have the right to request a copy of the in-car arrest video that goes along with your case. If the arresting officer didn’t follow procedure perfectly, the mistakes can be used as leverage by an attorney, influencing the outcome of your case. You also have the right to request counseling and/or intervention. This could also affect the outcome of your case.
  • Understand the penalty for your actions. If you are convicted of a Michign second DUI charge within seven years of your first DUI charge, you could spend between five days to one year in jail. Your license could be suspended for at least one year, you would get six license points, your license plate could be confiscated, your vehicle could be immobilized from 90 to 180 days, and you could be fined.

Understanding your actions, the repercussions, and your options will serve in your best interest as you prepare for court.

Do plenty of research so you are sure you want to become a lawyer. You have to have many skills including great analytical, organization, communication, and observation skills. If you think you have what it takes, you can proceed by applying to any college to get your bachelor’s degree.

Get a Bachelor’s Degree

There is no requirement for the type of bachelor’s degree you need to get into law school, but you need one in order to be accepted. It is a good idea to take classes in political science, business, English, and economics. If you want to specialize in any field once you’ve become a lawyer, aspire for a bachelor’s degree in that field. Make sure to keep your grades up and graduate with a high GPA.

Take Your LSAT Exam

Your LSAT (Law School Admissions Test) is important if you want to become a lawyer and get into law school. Prepare well by using online resources, purchasing study material, and using self-test booklets.

Apply for Law School

Once you have completed a bachelor’s degree and have passed the LSAT, you are prepared to apply to a law school. There is high competition, so it is important that you prepare yourself and apply to several different schools.

Working your way to become a judge doesn’t happen overnight. There are many years of school and experience needed if you want to become a judge. If you’re interested in the legal system and want to make executive decisions in the courtroom, but you can still be open-minded to both sides, it’s a great idea to work your way to becoming a judge.

Start Practicing Law

Most judges begin their careers as an attorney. It is important that a judge is well-educated in the political field and has extensive experience. You will spend several years practicing law before you are ready to become a judge. The schooling to become a lawyer takes several years and you will have to research the criteria for the school you want to attend.

Research the Types of Courts in Your Area

Every court has different criteria on how to become a judge. In some courts, a judge will be appointed by a committee and in others you will be elected by the people. Each court may also have a different criteria for further education. Research the courts in your area and follow the proper guidelines.

Impress Nominating Commission

You will have to file paperwork with the judicial nominating commission when a vacancy appears in your court, and because the competition is so high, it is important that you impress this commission. Do all your research so you know what is required.

Finish Your Training

There may be training required, but you will have to check with the courts in your area. Be prepared for this training by researching what type of training you will go through and how long it will take.

What is a Legal Nurse Consultant?

A legal nurse consultant gives expert advice to lawyers and attorneys to assist them in their cases. They will give advice on medical malpractice, personal injury, sexual assault, wrongful death, and other types of cases. Duties may include researching and interviewing medical experts, reviewing victim’s medical records, help form medical-legal theories, serve as a witness in a trial or hearing, and perform many other tasks.  Legal nurse consultants can work for law firms or other organizations, or can be independent consultants.

Schooling

A legal nurse begins their career by becoming a nurse. You will usually want to get a bachelor’s degree in nursing, which takes four years and then be required to have at least five years of experience in the medical field. You can take legal nurse consulting coursework or become certified to help you excel in your career.

Skills

A legal nurse consultant needs to acquire many different skills. Desired skills include:

  • legal and medical terminology
  • and being well-educated in both fields

Working as a nurse pays good money, but add employment at a law firm and you will be making a large salary. Some legal nurse consultants make from $60-$100 an hour, where independent consultants can make up to $200 an hour for serving as an expert witness on the stand.
